    Ok, this may no be the right section to post but im curious either way...

    If you are looking to buy a car that has failed emissions, correct me if im wrong but doesnt the car have to pass emissions if sold in a requiring county?

    You can hagle the price lower to cover the expense but if im not mistaken the previous owner is still liable. Or is that dealer only?

    I figured I'd ask, thanks for the info.

    um ive never heard of that, but if i was selling a car i would at least tell the person it wasnt gonna pass.

    Iirc, seller is responsible for emission.usually Seller dont care it if it pass or not. as long it sells. Sometimes buyer don't care either, usualy bcs its a great deal. They don't want to miss out. From my experience, some seller don't care about current emission. Some do, they provide me with current emission paperwork. I guess to answer your qs, no it doesn't have to pass emission to sell?

    I think...

    FROM A DEALERSHIP it must pass emissions when they sell the car.. its the law ( not 100% but I get news letters from the state and they said that a couple months ago)

    but a private seller ... is not required to or its not the law.

    Correct me if you must but I think I'm close to being right

    From what I understand, the seller regardless of dealer or private will be fined if the car doesn't pass emissions. However if the country the seller lives in doesn't have emissions, I think its null and void.

    this is cool, i got curious and went to the clean airforce website and found the emissions reprint option, kinda cool you can just input a vin and it shows the report..

    According to Georgia law, the seller (regardless of location in Georgia) is responsible for selling a vehicle with a current, valid passing Georgia
    Vehicle Emission Inspection Report (VIR) if the buyer is going to register the vehicle in a Georgia county requiring emission testing. For 2010, all
    1986 - 2007 model year gasoline-powered cars and light-duty trucks (8,500 pounds gross vehicle weight rating or less) require an emission
    inspection.


    Vehicles sold ***8220;as is***8221; are not exempt from the requirements to have a current, valid passing VIR at the time of sale.

    For vehicles sold without a current, valid passing VIR, the Georgia Environmental Protection Division (EPD) has the option of pursuing
    administrative enforcement with penalties up to $5,000, or to seek criminal prosecution of the seller.
