Neighbor called the cops again...

Had a couple people over last night. We made it until after I was asleep. At around 5AM I got woken up to cops IN my house. One was standing outside the door and one was inside on my stairs.

First of all no one gave them permission to come in.

Apparently they got called because of a friends car when he was leaving. He has a decently loud camaro which is cammed and you can't really help but to make noise even when just starting it. He wasn't outside reving or anything.

The cops told me that they got a call about a silver camaro outside reving and peeling out and such. This is the same neighbor that calls the cops all the time.

Does anyone know the laws about noise as far as cars go at that hour? (5am) I'm trying to find out if she had any grounds calling the cops this time. In the past she had NO grounds.

I'm seriously considering pressing harassment charges against her so she'll quit it. The cops are always pretty nice when they come. They come so much they dont' really take her too seriously. Its so annoying to get woken up to cops.

My neighbor is doing this just despite me. I've been told this by another neighbor. I'm going to try to talk to her and see how that goes but this whole thing is just crazy. I'm not going anywhere so I want to put a stop to it one way or another.


Does anyone know a cop or someone that knows the laws pretty well that could give some advice?

They said the door was open. It was unlocked but not open... They have to have a warrant to come inside... :-\

I would file the harassment charges. You cant call the police for a loud car at 5am, alot of people get up to go to work at 5am.

Did anyone let the police in? Or did they just come in the door, cause I'm almost sure you could file something against them for unlawful entry or something of the like.

i agree. if the cops come to your house w/o a warrant you dont even have to open the door to talk to them. you can just talk to them thru the door. if you want to talk to them at all.

Anything loud before 7AM can be considered "disturbing the peace." Happened in the neighborhood where I live, the neighbors aren't as bad as flip's, and most of them are elderly, though between the hours of 10PM and 7AM...anything that is considered too loud for someone else can be considered disturbing the peace.

Though you can make all the noise you want on your own property outside of those times, she can't do anything...she can call the cops, but legally all they can do is come out there and ask you to be quiet...whether you quiet down or not is your choice and the cops can't fine you or anything unless it's beyond 10PM. At least, that's what I've been told by an ex-Cobb deputy.

then say you wanted to file a harrasment complaint against your neighbors.
state that she calls the police on you ALL the time. get the nessesary paperwork and show it to her :P

i believe the sound law for cars is 95-96 decibles from 2000-6500 rpm but dont quote me.
but yea they cant come in w/o a warrant if u arent there why would they come to your house if the dtp happened in the street and the suspect was gone. that makes no sense.

Hey I have a similar problem where I live. On 2 occasions some neighbor of mine (I have an idea which one...) has called the pound on me and my roommate for our dogs.
once because my puppy jumped the fence like a kangaroo, but was quickly retrived before they got there. and another time when everything was in order for no reason.
Nonetheless the guy that comes out always says everything is cool, but It gets annoying as hell.
I can't wait to move this month

that's the complete opposite for me we burnout, cut donuts, drift and even let the fwd kids tray drift (all of this taking place around 3 or 4 a.m.) in his neighborhood and nobody really cares

but no there is no law regarding what time you can run a car that is louder i mean get hammered sit on your front porch and watch for her to do something

hell i'd call the cops and say she's making alot of noise in her house if she stays up to like midnight watching t.v.

but yeah you could definitally get a harassment charge put on her, but it's always better if you talk to her about it first because if you don't and you take it to court the judge will probably throw it out for not trying to resolve it personally
